1. General

The terms of sale of all goods supplied by us via this website are governed by the following terms and conditions.

Please read them carefully before placing your order.

Your statutory rights are not affected

You must be over the age of 18 to purchase alcoholic products from us. If you are buying the product for someone else the recipient must also be over the age of 18.

The goods are offered to you for sale as purchaser as described and at the price stated. No contract exists between us until we have received your order and accepted it.

You may cancel your order – see Section 4.

We retain the right to cancel the contract if the payment is not received or for the matters set out at paragraph 2 below.

2. Product Information

The products offered for sale on this website have been described as accurately as possible. If you are concerned about any aspect or require further information before placing your order, please contact us.

Despite our best efforts if an error in pricing or other material matter is identified after you have placed your order, we will contact you and offer one of the following options:

  • To place a new order at the correct price
  • Cancel the whole order
  • Cancel the order for the incorrectly identified goods only

If you do not choose one of the above options within 14 days of being notified, the order will be cancelled, or the incorrect item/s will be removed from your order. If payment has been received from you it will be refunded as appropriate.

If within 7 days of accepting your order, we find that some or all of the goods are not available we will contact you to agree how to proceed. In a case where all or part of the order is subsequently cancelled, we will refund the payment made by you.

The price of goods stated in this website do not include delivery which is shown separately at the checkout.

Payment for goods will be made using the Stripe payment system and is due before despatch and delivery. If for any reason the payment fails, the order will be cancelled.

3. Delivery

Delivery will be made to address provided by you and by the carrier of our choosing.

We will make every effort to deliver your goods as soon as reasonably practicable after receiving your order and payment is made. However, we will not be liable for any loss or damage to you through reasonable or unavoidable delay. Where possible we will inform you of any known delays.

If you refuse delivery or cancel the contract under the Consumer Rights Regulations, we will refund you all payments made for the goods supplied. By exercising your right under the above you must return the goods unopened, in original packing and in good condition.

The goods must be signed for on receipt and where possible checked for completion and condition. If you are unable to check the package please sign for them as unchecked and contact us as soon as possible if there is an issue.

4. Cancellation

We are unable to accept returns in the following circumstances:

  • Where the goods have been open or tampered with
  • Goods that are personalised or ordered specifically for the customerā€™s individual requirements

Under the Consumer Rights Regulations you have the right to cancel the contract up to 14 days after you have received the goods. In these circumstances the goods must be returned to us and you will be responsible for that cost unless the goods are faulty.

In the circumstances outlined in the paragraph above we must receive the goods within 14 days of your notice to cancel, and you will be refunded within 14 days of the goods being received by us.

5. Refunds

If you are eligible for a refund it will be made using the card details you used for the purchase. It is your responsibility to notify us of any changes. Refunds can take up to 14 days to process.

6. Returns

We will provide a refund or replacement where the goods are faulty. We must be notified of damaged or faulty goods within 14 days of receipt. We may require the goods to be returned to us and will contact you in those circumstances.

As identified above it is your responsibility to check the goods on delivery. We will not accept any claims for breakages or shortages unless they are stated on the carrierā€™s documentation or where it has been noted that the goods were unchecked at the time. We must have notification of these matters within 14 days of delivery. We may require the goods to be returned to us. Once we are satisfied with the claim, we will either replace the damaged goods and return to you at our expense or provide a refund.

Where the wrong goods have been delivered or an item is no longer required, we must be notified within 14 days of delivery. The goods must be returned to us and in the latter case at your expense and must be received within 14 days of the notice.

We will either replace with the correct goods or refund the payment as appropriate.

7. Copyright

We own all the intellectual property rights in the images and materials contained on the website which are for illustrative purposes only.

The website and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of The Lincoln Distillery Limited. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a licence in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Lincoln Distillery Limited be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, The Lincoln Distillery Limited assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

9. Law & Jurisdiction

These terms are governed by English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
